Parenting Provisions to Include in Child Custody Arrangements

child custody attorneysCollaborating with an ex-partner in order to hash out child custody arrangements is hardly a straightforward affair, and it is important that you take all factors into consideration before the ink dries and all terms of your child custody arrangement are finalized. One thing we have noticed is that while parents expect to wrangle with the terms included in the finalized arrangement, many are blindsided by the elements which weren’t included in any talks or formal arrangement.

This blog post discusses a few, often-forgotten provisions that should not be neglected. The best way to prevent future complications is to consult with a skilled family law attorney, but for now, here are some key provisions to remember as you work towards a finalized child custody arrangement.

Drop off and Pick Up Arrangements

Logistics are easily tossed to the side when emotions run high, but details such as where and how your child is to be picked up and dropped off matter. For example, it might be a good idea to specify that a third party cannot transport and exchange the children on an ex-spouse’s behalf, at least not without prior approval.

Transportation Requirements

Likewise, be sure to include language that defined the requirements for transport whenever the children are involved, including requiring that all drivers follow the law and are fully insured. This is also a good opportunity to specify other aspects of future exchanges, including whether a parent will travel to the other party’s residence or wait in a public place, wait inside the car during the exchange, etc.

Accommodations in Separate Homes

Along these same lines, it can be beneficial for you and your children to establish specifics that apply to each home. For example, what sleeping arrangements do they have in either home? What type of clothing, toys, and other possessions stay where? These types of arrangements help keep everyone on the same page and allows you to avoid future conflict.

Be sure to keep these provisions in mind, and take the time to think about other considerations worth including in your child custody arrangement. Need more detailed guidance? For more information, do not hesitate to reach out to the family law and divorce attorneys at Rubin & Levavi, P. C.
